These Terms of Service apply to purchases made through the Ikiru Tea online store. By using our website or placing an order with us, you agree to these Terms of Service. Nothing in these Terms affects any mandatory rights you may have as a consumer under applicable law.
1. About Ikiru Tea
Ikiru Tea is a Netherlands-based tea company specialising in Japanese tea and matcha.
Our online store is powered by Shopify. Purchases made through our store are made directly between you and Ikiru Tea.
Our full business and contact details are provided at the end of these Terms.
2. Products
We make every reasonable effort to describe and display our products accurately.
Tea is a natural agricultural product. Characteristics such as colour, aroma, flavour and appearance may therefore vary slightly between harvests and batches. Product colours may also appear differently depending on your screen and device settings.
Product information, including ingredients, net weight, origin, storage instructions and best-before information, is provided on the relevant product page and/or product packaging where applicable.
We may change our product range and discontinue products at any time. Product availability is subject to stock.
3. Prices and Payment
All consumer prices displayed on our website include applicable VAT unless expressly stated otherwise.
Any applicable shipping costs are displayed before you complete your order.
Payment can be made using the payment methods available during checkout. Your order will be processed once the applicable payment requirements have been met.
We reserve the right to correct obvious pricing, typographical or technical errors. If such an error affects an order you have already placed, we will contact you where necessary before proceeding.
4. Orders
By placing an order, you offer to purchase the products in your order.
After placing an order, you will receive an electronic confirmation. We may refuse or cancel an order where there is a legitimate reason to do so, including an obvious pricing error, payment failure, suspected fraud or product unavailability.
If we cancel an order after payment has been received, the relevant amount will be refunded using the original payment method where reasonably possible.

5. Shipping and Delivery
We deliver to the destinations made available during checkout. Available shipping methods, shipping costs and estimated delivery times are displayed on our website and/or during checkout.
Delivery times are estimates unless a specific delivery date has expressly been agreed.
If circumstances outside our reasonable control cause a delay, we will handle the situation in accordance with applicable law. Your statutory consumer rights remain unaffected.
For consumers, the risk of loss of or damage to the products passes to you when you, or a third party designated by you other than the carrier, physically receive the products, unless applicable law provides otherwise.
6. Right of Withdrawal and Returns
If you are a consumer in the European Union or another jurisdiction providing a statutory right of withdrawal, you generally have the right to withdraw from an online purchase within 14 days after receiving the goods, without giving a reason, subject to applicable legal exceptions.
Certain products may be excluded from the right of withdrawal where permitted by law. For example, the right of withdrawal may cease to apply to sealed goods that are not suitable for return for reasons of health protection or hygiene once the seal has been broken, provided the applicable legal requirements for that exception are met.
Food products are not automatically excluded from the statutory right of withdrawal solely because they are food products.

Nothing in these Terms or our Return & Refund Policy limits your mandatory statutory rights in relation to defective, damaged or non-conforming products.
7. Product Quality and Complaints
Our products must conform to the agreement and meet the standards you may reasonably expect under applicable consumer law.
If you receive a product that is damaged, defective, incorrect or otherwise does not conform to your order, please contact us at info@ikirutea.com and provide your order details. We may ask for photographs or other information where reasonably necessary to assess the issue.
We will assess complaints and provide an appropriate remedy in accordance with applicable law.
8. Storage and Use
Tea, and matcha in particular, is sensitive to factors including heat, moisture, light and odours.
For optimal quality, products should be stored and used in accordance with the storage instructions provided on the product, its packaging or our website.
To the extent permitted by law, we are not responsible for deterioration in product quality resulting from improper storage or handling after delivery.
9. Intellectual Property
Unless otherwise stated, the content of this website, including the Ikiru Tea name, branding, text, photographs, graphics, videos, product presentation and other original content, is owned by or licensed to Ikiru Tea and is protected by applicable intellectual property laws.
You may use our website for personal and non-commercial purposes.
You may not reproduce, distribute, modify, republish or commercially exploit our content without our prior written permission, except where such use is permitted by law.
All third-party trademarks, names and other intellectual property remain the property of their respective owners.
10. Third-Party Services and Links
Our store is powered by Shopify and may use third-party providers for services including payment processing, shipping, analytics and other functionality.
Our website may also contain links to websites or services operated by third parties. We are not responsible for the content, availability or practices of third-party websites that are outside our control.
Where you use a third-party service, that service may also be subject to the provider’s own terms and privacy policy.
11. Privacy
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.
Our Privacy Policy explains, among other things, what personal information we collect, why we process it, how it may be shared and the rights available to you.
12. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by law, Ikiru Tea is not responsible for losses or damage resulting from improper use or storage of our products, misuse of our website, or circumstances outside our reasonable control.
We do not exclude or restrict any mandatory statutory rights or remedies available to consumers.
13. Force Majeure
We are not responsible for a failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will inform you where reasonably possible and handle the order in accordance with applicable law.
14. Changes to These Terms
We may update these Terms of Service from time to time, for example to reflect changes to our services, business practices or applicable law.
The version applicable to your purchase is the version in effect at the time you place your order, unless applicable law requires otherwise.
The most current version of these Terms will be available on our website.
15. Governing Law and Disputes
These Terms of Service are governed by Dutch law.
If you are a consumer residing in another EU or EEA country, this choice of law does not deprive you of mandatory consumer protections granted to you under the law that would otherwise apply.
If you have a complaint or dispute, please contact us first at info@ikirutea.com so that we can attempt to resolve the matter.
Any dispute will be submitted to a competent court in accordance with applicable law. Nothing in these Terms restricts a consumer’s right to bring proceedings before a court that has jurisdiction under mandatory consumer protection rules.
